Domain Nepper – China Net Technology Limited
Wenn Sie Inhaber einer oder mehrerer Marken oder eines bekannten Firmennamens sind werden Sie von Zeit zu Zeit auch von Domain Neppern per Telefon, Post oder E-Mail belästigt. Da deren Vorgehen höchst unseriös ist versteckt man sich mit dem Firmensitz zumeist ausserhalb der EU. Bevorzugt zum Beispiel die Schweiz, USA oder auch China was mich zu einem aktuellen Fall von China Net Technology Limited bringt.Heute habe ich zum Beispiel eine E-Mail von China Net Technology Limited www.netinchina.com.hk erhalten in welcher ich darauf hingewiesen werde, dass der große Unbekannte (Wachovia Investment company) folgende Domains reservieren möchte:

promomasters.org.cn
promomasters.name
promomasters.tw
promomasters.hk
promomasters.mobi
promomasters.asia
Da hat sich China Net Technology Limited doch die Arbeit gemacht und herausgefunden, dass ich diesen Firmennamen und/oder Marke PromoMasters habe. Um meine Rechte zu schützen soll ich einen Mitarbeiter von China Net Technology Limited bitte schnellstens kontaktieren. Die sind sooo lieb – denn die würden meine Domains dann nicht an die böse Wachovia Investment company abgeben sondern ich darf diese zu überteuerten Preisen bei China Net Technology Limited bestellen.
Der Nepp liegt klar auf der Hand: Es wird ein Interesse an meinen Domains vorgespielt und ich soll unter Druck dazu gebracht werden diese Domains zu kaufen. Dann lassen wir uns doch mal überraschen ob die Wachovia Investment company diese Domains kauft. Bis heute wurde nach keinem der Nepp-Versuche auch nur eine der erwähnten Domains reserviert. ACHTUNG: Es gibt noch andere Formen des Nepps wie den Transfer Ihrer Domain zu einem anderen Registrar welcher hinter einer Verlängerung versteckt wird.
14. Mai 2009 – seit Heute ist mir auch die EUROPA DOMAIN REGISTRIERUNG in CH-8050 Zürich aufgefallen.

Habe auch diese e-mail von China Net Technology bekommen und werde sie einfach ignorieren. Meiner Meinung nach sollte man mit chinesischen Geschäften ohnehin seeeeehr vorsichtig sein. Vieles wird kopiert, dann billig nach Europa verschifft, hier leider gekauft und die Arbeitsplätze gehen kaputt…..und die Umwelt ist den Chinesen auch komplett egal.

Auch wir haben eine solche E-Mail erhalten, die ich ebenfalls ignorieren werde.
Manchmal ist es eben wirklich sinnvoll, ein bisschen nachzugoogeln, wenn man von wildfremden Leuten E-Mails erhält, die einen beunruhigen sollen.

Gibts auch per Telefon.
Bekam heute den Anruf einer ominösen Domain-Firma, die mir freundlicherweise mitteilte, dass ein ganz böser Mensch gerade bei ihnen Domains, die unserer Firmendomain ganz ähnlich seien, registrieren und auf eine widerliche Porn-Seite routen wolle. Wenn ich jetzt sofort am Telefon zusagen würde, könnte ich die Domains für den Vorzugspreis von €79 / Jahr haben.
Ich müsse aber sofort zusagen, Rückruf sei nicht möglich, sobald ich auflegen würde, hätte die Pornofirma die Domains. Man sei dann rechtlich dazu verpflichtet, da ich mit Auflegen des Hörers mein Einverständnis dazu geben würde.
What a load of bullshit. Ärgere mich im Nachhinein, dass ich freundlich geblieben bin.

Schön sowas zu lesen, denn wenn ich ehrlich bin – als ich die Mail gelesen habe, war das nicht wirklich erfreulich, aber zum Glück gibt’s ja google.

Hallo zusammen,
wir haben auch einige Mails diesbezüglich bekommen größtenteils kann ich Euren Kommentaren zustimmen.
Leider hatten wir aber auch eine Firma die eine Domain registrieren wollte und tatsächlich eine Firma aus dem asiatischen Raum war, die bei uns Kunde ist und unsere Produkte verkauft.
Nachdem wir bereits 2 offene Verfahren bezüglich Markenrechtsverletzungen durch Dritte führen, bin ich der Meinung sollte man nicht grundsätzlich bei international tätigen Unternehmen diese Mails ungelesen vernichten.
Bezüglich des Internet brand keyword: bin ich mir aber etwas unschlüssig. Nach meinem Kenntnisstand handelt es sich dabei um das von Realname angestrebte Verfahrens einer vereinfachten Adresseingabe dieses Vorhaben ist aber 2002 eingestellt worden.
Erweiterungen die diese Eingabe unterstützen um z.B. per asiatische Schriftzeichen europäische Firmennamen einzugeben habe ich nicht gefunden.

Grundsätzlich sehe ich bei Domaine nicht so eng , denn wir haben bereits unserdomain.de und .com(’unserdomain’ ist in dem Artikel unsere Markenamen und gleichzeitig Domainname ), denn können wir nicht alle AsiaDomaine schützen. Problem ist ein sogenannter ‘internet trademark’. Als ich das Email gelesen habe, habe ich gleich den ‘netten’ Honkonger angerufen und gefragt was es sein soll. Die Antwort: ‘internet trademark’ kann man registrieren/kaufen und man bekomme von chinesischer Behörde sogar eine Lizenz dafür.Diese registrierte ‘internet trademark ‘ beeinflusse/bestimme Suchmaschine wie google,(in China beliebt http://www.baidu.com), dass die Webseite gefunden wird. Ich weiss nicht ob es war ist,dachte zumindest google hat doch eigene Algorithmus??Angebot für ‘internet trademark ‘ aus Hongkong ist mit Euro(klar!):

Es wäre eine Katastrophe wenn in Suchmaschine eingegebene geklaute Internetmarke auf andere Seite linkt statt auf unsere Homepage!!Insbesondere wir haben auch in China Kunden. Weiss jamend was darüber?
Ich bin selber Chinese und hasse solche Domain Nepper wie die Pest. Leider haben solche Leute/Firma scheinbar nix besseres zu tun als andere Unternehmen zu schädigen oder erpressen.

@w.yin – also so eine Sammlung an Falschaussagen traut sich auch nur jemand zu machen der sich der Europäischen Gerichtbarkeit entzieht. Scheinbar ist die Chinesische Vorstellung von Moral und Anstand zur europäischen doch sehr unterschiedlich. Man darf nicht alle Staatsbürger von China nun in einen Top werfen aber es scheint schon so, dass im geschäftlichen Bereich so einiges gar nicht unseren Wertvorstellungen entspricht.
Ein Internet Trademark ist der größte Humbug an Selbsterfindungen den ich seit langer Zeit gehört habe. Was bekommt man für 110 Euro pro Jahr? Nichts anderes als eine Domain mit asiatischer Endung die man überall reservieren kann. Die tatsächlichen Kosten liegen hier bei rund 20 Euro pro Jahr. http://www.google.at/search?q=.asia+domain
Dass man mit der Asia Domain in baidu auch besser gelistet werden kann ist genauso wie wenn die DENIC euch verkaufen würde, dass ihr mit der .DE Domain auch bei Google.de aufgenommen werdet. Klar, jede Suchmaschine versucht regionalen Domains und Webauftritten den Vorzug zu geben aber dafür brauche ich keinen domaininasia.com Nepper.
Grundsätzlich gilt zwar das First Come – First Server Prinzip aber letztendlich gibt es noch den Markenmissbrauch und da kommen unsere asiatischen Freunde in Erklärungsnot. Aber wie man immer wieder an Messen in Europa erkennt ist ein Marken und Patentrecht in China scheinbar nicht bekannt oder wird vielfach einfach ignoriert.
Mein persönliches Fazit bleibt gleich: hier wird mit fadenscheinigen Argumenten versucht Domains zu weitaus überhöhten Preisen Asdien Domains zu verkaufen. Die Art und Weise wie hier vorgegangen wird muss ich für mich persönlich als betrügerisch einschätzen und erinnert mich mehr an Kaffeefahrten als an einen Registrar Service. Darum bin ich auch bemüht, dass dieser Blogpost Leute aufklärt und diese danach noch immer entscheiden können ob sie bei domaininasia.com bestellen oder nicht – jeder wie er will.

@Seed: in short: companies in Europe are getting mails from asian domain registrars which pretend that another company (which is often made up) is trying to register asian domain names which contain brand names. Those mails aim at getting the real brand holders outside Asia to register those domain names themselves, at ridiculously high prices, before the bogus competitor registers them.

In answer to that we did the following as a very tough measure.
1. We informed them not to contact us again in regards to that as they will be voilating the anti-spam legislation (Our council is on stand by).
2. We have notified http://www.antispam.gov.hk/ and raised a issue against the company.
3. We have also notified http://www.ftc.gov/spam/ and raised a issue against this company.
Hope it will help some one who wants to take a stand against this spam tactics.
